Terms & Conditions

Web Hosting Agreement and Terms of Service:
1. *Account Setup*: Your account is set up after payment receipt and verification.
2. *Changes in Packages and Pricing*: Prices and services can change anytime without prior notice, affecting new deals.
3. *Non-Payment*: 
   - 7 days overdue: No technical support.
   - 14 days overdue: Suspension of site and services.
   - 30 days overdue: Deletion of sites and data.
   - Chargebacks lead to immediate account termination and data deletion.

Regular Updates:
- Clients must keep their contact information updated to receive notices and avoid responsibility for missed communications.

Spam Policy:
- Zero tolerance towards spam. Violations lead to account termination and penalties (Rs. 5000 for the first violation, Rs. 7500 for repeat offenses).

Prohibited Use of Services and Products:
- Illegal activities, harm to others, copyright/trademark violations, and network security breaches are strictly forbidden.
- Resource-intensive scripts and programs are not allowed.

Data Backup and Responsibility:
- Clients are responsible for data backup. Digital Vyapaar takes weekly backups for server restoration only.

Ownership:
- Clients do not own the web server, CMS, database software, or source code.
- Clients own HTML/CSS/JavaScript, visual design, and text content upon final payment.

Domain and Hosting Details:
- Digital Vyapaar retains control over web hosting credentials and domain names, providing them only under specific conditions.

Support:
- Provided through email for basic functions and certain limitations. No support for third-party software errors or bugs.

Third-Party Software:
- Clients bear responsibility for installing third-party software. Accounts may be terminated for security breaches resulting from such installations.

Liability and Disclaimer:
- Digital Vyapaar is not responsible for data loss, crashes, system failures, or expected profits. Changes to terms can be made anytime without notice.

Copyright Policy:
- All materials/services are protected by copyright law. Unauthorized replication is subject to legal action.

Privacy Policy:
- Information provided by clients is used in accordance with the law and shared within Digital Vyapaar divisions only.

Payment and Refund Policy:
- Payments are accepted via standard modes, and no refunds are provided. Payments should be made in favor of "Digital Vyapaar" only.

Disputes and Jurisdiction:
- Legal disputes are subject to the jurisdiction of courts in Noida, India.

Governing Law:
- The agreement is governed by the laws of India, with exclusive jurisdiction in Noida.
